Most of the construction falls then resulted in serious accidents involve a construction worker who was wearing his harness and hardhat all the way to the ground.

Being a personal injury lawyer in Indiana is a privilege and not a right. Personal injury clients, however, do have rights, and that I would take this opportunity to enumerate at least some of them.
1. The right to have phone calls return promptly. 2. The right to be kept informed of the status of their case. 3. The right to be honestly told of the value of their case, not just in the end, but also in the beginning. 4. The right to be charged a reasonable fee. 5. The right to be referred to another lawyer when necessary. 6. The right to have their case proceed to as quick a favorable resolution as possible. 7. The right to have a lawyer who is willing to try the case. 8. The right to have a lawyer who is willing to advance the necessary cost of prosecuting the case. 9. The right to determine whether to accept a settlement offer or proceed to trial. 10. The right to speak directly to the attorney they hired, and not an associate or paralegal.
While these are just some of the rights every personal injury client should have, unfortunately, not all attorneys are willing to recognize them. I will keep a copy close at hand to remind me of my client's rights, and my obligations to them.
While the vast majority of my clients are construction workers who suffered worksite injuries, these rights and obligations are the same for all of my clients.

Many of the construction accident lawsuits in Indiana are a result of a lack of fall protection. Whether the accident involves a fall from a scaffold, roof, structure or scissor lift, the resulting work injury can be fatal (or worse). Fall protection is not a matter of providing individual pieces of equipment to individual construction workers. Rather, it is a safety measure that should be considered and every stage of construction, from the designing of the building by the architect to the fabrication of steel by the fabricator and a pre-job hazard analysis should be performed any time construction workers are exposed to a height of greater than 6 feet. While OSHA and IOSHA regulations require fall protection at different heights, the better practice is to implement the "six-foot rule" in all phases of construction. For example, I OSHA regulations only require rails on scaffolding at 10 feet, and fall protection for ironworkers who are performing decking in a controlled decking zone at 30 feet. As any work injury lawyer in Indiana and Kentucky you, a fall from 30 feet will almost always be a fatality, or at a minimum, paralysis.

Your Indiana construction accident lawyer is sad to report that 52 year old John Garrett of Owensville died in a scaffold collapse accident while working on a power plant being built for Duke energy in Edwardsport Indiana. Apparently, Mr. Garrett was painting inside a tank when the scaffolding he was on collapsed. Here is a link to a newspaper account of the accident.
It is not clear from the initial reports whether Mr. Garrett was on a suspended scaffold or a supported scaffold. If he was on a suspended scaffold, then an additional lifeline should have been provided. If he was on a supported scaffold, then there is clearly a problem with the erection of the scaffold, with either an improper base or components.
Our Thoughts and Prayers are with Mr. Garrett's family.

Tragedy has once again visited in Indiana construction site. On March 20 6, 2010, 53-year-old Donald Smith died after falling some 30 feet from a roof while working for a project for Keystone Builders. Apparently, there were coworkers on the roof with Mr. Smith, but they did not see him fall. The building was located at 321 S. Union St in Warsaw, Indiana. Here is a link to the story. IOSHA is investigating the senseless death of this construction laborer.
Fall protection is an essential part of any building project were workers are exposed to a fall in excess of 6 feet. Ideally, the fall protection system will be designed in from the planning stage onward. OSHA and IOSHA require an employer to have the fall protection system be in place before the construction work begins.
When working from a roof, either a fall restraint system can be used, full monitors, or a personal fall arrest system. "None of the above" is not an acceptable response, and a failure to plan is a plan to fail. Your Indiana construction accident lawyer will be surprised if the responsible parties are not cited and heavily fined for a tragedy that would have been easily avoided. Our thoughts and prayers go to the Smith family.
