Crane Accident and Collapse kills Northern Indiana Worker- Comments from Indiana Construction Accident Lawyer

Friday, June 18, 2010 by John Daly

A 45 Year Old worker was killed Thursday as a result of a crane collapse. The Crane was being used to cleanup a train derailment that had happened on Wednesday Near Highway 6..  Ironically, no one was injured in the train derailment. It appears the Crane tipped over, which typicallly means the terain was inappropriate for the mobile crane, possibly because of weather making the ground unsafe. I am confident  IOSHA will investigate and get to the bottom of this tragedy to make certain such fatal accidents can be prevented.  There are several crane safety videos and links on this website, feel free to search. Our Thoughts and Prayers are with this unfortunate man and his family. JPD

FREE PERSONAL INJURY CASE EVALUATION from Your Construction Accident Lawyer in Indianapolis

Monday, June 14, 2010 by John Daly

Have you been injured in a construction accident  in Indiana? Not all personal injury lawyers are Construction Accident Lawyers, so it is important that you consult with a personal injury attorney who is familiar with construction site injuries, IOSHA regulations, OSHA regulations and the contractual and legal obligations of General contractors, subcontractors and owners for workers safety. I am  Happy to provide a FREE CASE EVALUATION for any construction related injuries, including crane accidents, workers compensation, scaffold accidents, road construction accident and trench collapsed accidents.  Our construction accident law firm is located in Indianapolis, but we have a statewide practice, including Fort Wayne, South Bend, Evansville, Bloomington, Terre Haute, and Richmond.  The legal and technical issues regarding a construction site accident are complex, particularly if the worker has been killed, or suffered a brain injury, and is unable to relate his version of the events.  Unfortunately, your Indiana construction accident lawyer frequently sees efforts to cover up construction site accidents, and a "blame the victim" mentality.  For example, in a fall protection case involving an iron worker, it is not enough for the employer to provide a harness, but must also provide an anchor point, lifeline and lanyard in order for fall protection system to be effective.  Most of the construction falls then resulted in serious accidents involve a construction worker who was wearing his harness and hardhat all the way to the ground.

If you or a loved one was injured in a construction accident, please do not hesitate to call.  Worker's compensation will be terminated long before a full recovery is made, leading you with unpaid medical expenses and an inability to return to work.  A construction safety lawyer in  Indiana knows why and where to bring a construction accident lawsuit in  Indiana. BE SAFE- Contact me for a free case evaluation.

Indiana Personal Injury Client's Bill of Rights from Your Indiana Construction Accident Lawyer Indianapolis

Friday, June 11, 2010 by John Daly

Being a personal injury lawyer in Indiana is a privilege and not a right.  Personal injury clients, however, do have rights, and that I would take this opportunity to enumerate at least some of them.

1.  The right to have phone calls return promptly.
2.  The right to be kept informed of the status of their case.
3.  The right to be honestly told of the value of their case, not just in the end, but also in the beginning.
4.  The right to be charged a reasonable fee.
5.  The right to be referred to another lawyer when necessary.
6.  The right to have their case proceed to as quick a favorable resolution as possible.
7.  The right to have a lawyer who is willing to try the case.
8.  The right to have a lawyer who is willing to advance the necessary cost of prosecuting the case.
9.  The right to determine whether to accept a settlement offer or proceed to trial.
10.  The right to speak directly to the attorney they hired, and not an associate or paralegal.

While these are just some of the rights every personal injury client should have, unfortunately, not all attorneys are willing to recognize them.  I will keep a copy close at hand to remind me of my client's rights, and my obligations to them.

While the vast majority of my clients are construction workers who suffered worksite injuries, these rights and obligations are the same for all of my clients.

If you need the services of a personal injury lawyer in Indiana, whether as a work injury lawyer, job accident lawyer, road  construction accident lawyer, scaffold accident lawyer, iron worker accident lawyer, or trench collapse lawyer, I am happy to help.  I will  provide you with a free case evaluation, and in the meantime, please feel free to review the free guide to construction accident litigation.

We represent injured construction workers and their families throughout the State of Indiana, including Indianapolis, Fort Wayne, Evansville, Terre Haute, Richmond, New Castle, South Bend and Bloomington, and all points in between.  Here are some OSHA and IOSHA tips regarding preventing construction accidents in Indiana.  If you have any questions, please contact me, there is never a charge for a consultation.  Believe me, we certainly turn down more cases that we take, and I am always happy to give a free case evaluation.

Fall Protection Tips from Your Indiana Construction Accident Lawyer Indianapolis

Thursday, June 10, 2010 by John Daly

"Not All Personal injury Lawyers are Construction Accident Lawyers!"  John Daly , Indiana Construction Accident Lawyer.

Many of the construction accident lawsuits in Indiana are  a result of a lack of fall protection.  Whether the accident involves a fall from a scaffold, roof, structure or scissor lift, the resulting work injury can be fatal (or worse).  Fall protection is not a matter of providing individual pieces of equipment to individual construction workers.  Rather, it is a safety measure that should be considered and every stage of construction, from the designing of the building by the architect to the fabrication of steel by the fabricator and a pre-job hazard analysis should be performed any time construction workers are  exposed to a height of greater than 6 feet.  While OSHA and IOSHA regulations  require fall protection at different heights, the better practice is to implement the "six-foot rule"  in all phases of construction.  For example, I OSHA regulations only require rails on scaffolding at 10 feet, and fall protection for ironworkers who are performing decking in a controlled decking zone at 30 feet.  As any work injury lawyer in Indiana and Kentucky you, a fall from 30 feet will almost always be a fatality, or at a minimum, paralysis.

If you were a loved one has been injured in a construction accident in Indiana, our worksite injury lawyers will be happy to provide you with a free case evaluation.  If you are concerned about whether you have a case, please review our INDIANA CONSTRUCTION ACCIDENT GUIDE.  We represent injured iron workers, masons, electricians, laborers, operators and other construction workers throughout Indiana, including Indianapolis, or Wayne, Bloomington, South Bend, Terre Haute and Evansville.  We will be happy to come to you and answer any questions you may have, without obligation.  As promised, here are some fall protection tips:

"Not All Personal Injury Lawyers Are Construction Accident Lawyers!" - Indiana construction accident lawyer John Daly.

Unfortunately, not all Indiana construction accidents are quickly resolved and the injured construction worker returns to work.  Serious accidents involving fractures, head injuries and even death result in, at a minimum, the need for a career change.  While many employers indicate a loyal worker who has been seriously injured on the job has a job for life, the reality is that the injured worker who is limited to light duty is the first one laid off and the last one recalled.  You only have two years from the date of the construction accident in Indiana to hire a lawyer to see if you have a third-party claim against the general contractor, the owner of the project, or another subcontractor.  There is certainly no harm in consulting a construction accident lawyer, particularly for a free case evaluation in determining if you have a case.

We have represented hundreds of Indiana construction workers were placed accidents involving scaffolds, trench collapses, falls, electrocutions, crane accidents and iron working.  We represent laborers, ironworkers, masons, electricians, painters, drywall hangers, operating engineers and road construction workers throughout Indiana, including Indianapolis, South Bend, Fort Wayne, Evansville, New Castle, Terre Haute and Bloomington. Scaffold Accident Kills Indiana Construction Worker John Garrett

Thursday, May 27, 2010 by John Daly

Your Indiana construction accident lawyer is sad to report that 52 year old John Garrett  of Owensville died in a scaffold collapse accident while working on a power plant being built for Duke energy in Edwardsport Indiana.  Apparently, Mr. Garrett was painting inside a tank when the scaffolding he was on collapsed. Here is a link  to a newspaper account of the accident.

It is not clear from the initial reports whether Mr. Garrett was on a suspended scaffold or a supported scaffold.  If he was on a suspended scaffold, then an additional lifeline should have been provided.  If he was on a supported scaffold, then there is clearly a problem with the erection of the scaffold, with either an improper base or components.

Our Thoughts and Prayers are with Mr. Garrett's family.

Here is some scaffold safety information that may help prevent another tragedy.

"Not All Personal Injury Lawyers are Indiana Construction Accident Lawyers."- John Daly

Your Indiana Construction Accident Lawyer is often called to be a Crane accident Lawyer.  These  frequently involve iron workers, operating engineers, and laborers.  Although rigging accidents are common in which a load is accidentally released during a lift, crane operators are often placed in harm's way and by overhead power lines which are not deenergized prior to the lift.  Rigging accidents can have many causes, from improper training on rigging, inadequate supervision, poor design of the object being lifted or rigging equipment that is damaged or insufficient for the lift.  Whatever the cause, there are no minor personal injuries resulting from a Crane accident.

If you or a loved one have been injured in an Indiana construction accident involving a Crane, he may be entitled to more than worker's compensation.  Although some work injury lawyers focus on the workers compensation aspect of your case, your Indiana construction accident lawyer emphasizes the third-party aspect of the case against the general contractor or others who have assumed, and had been paid for, responsibility for safety on the entire project.

Donald Smith Fall From Roof Preventable- Your Indiana Construction Accident Lawyer in Indianapolis

Tuesday, April 27, 2010 by John Daly

"Not All Work Injury Attorneys Are Indiana Construction Accident Lawyers."

Tragedy has once again visited in Indiana construction site.  On March 20 6, 2010, 53-year-old Donald Smith died after falling some 30 feet from a roof while working for a project for Keystone Builders.  Apparently, there were coworkers on the roof with Mr. Smith, but they did not see him fall.  The building was located at 321 S. Union St in Warsaw, Indiana.
Here is a link  to the story. IOSHA is investigating the senseless death of this construction laborer.

Fall protection is an essential part of any building project were workers are exposed to a fall in excess of 6 feet. Ideally, the fall protection system will be designed in from the planning stage onward.  OSHA and IOSHA require an employer to have the fall protection system be in place before the construction work begins.

When working from a roof, either a fall restraint system can be used, full monitors, or a personal fall arrest system.  "None of the above" is not an acceptable response, and a failure to plan is a plan to fail.  Your Indiana construction accident lawyer will be surprised if the responsible parties are not cited and heavily fined for a tragedy that would have been easily avoided.  Our thoughts and prayers go to the Smith family.

Injured? Scared?? Broke??? Your Indiana Construction Accident Lawyer in Indianapolis is Here to Help

"Not All Work Injury Lawyers Are Construction Accident Lawyers".  John Daly, Indiana Construction Accident Lawyer

I just returned from meeting with a new client, and realized that when someone has been injured in a personal injury accident, the result is they are hurt, scared and facing bills and lost wages that will leave them broke, or worse.  Family and friends will help as much as they can, but times are tough and there is only so much they can do. As they say on the airplanes- " Put your own air mask on first before you try to help others!".

My job as your lawyer is to step in when your own resources fail. By only getting paid when  you recover, Your case is my case.  First, we make sure your medical treatment is taken care of, with or without health insurance. Then we investigate your accident to see where responsibility lies. If it is simple, like an auto accident, then we attempt to negotiate a settlement on your behalf with the defendant's insurance company. If unsuccessful, or the case is more complicated, like a construction site accident, then we file suit immediately to begin the litigation process. If workers compensation is involved, we may assist, or recommend a lawyer who specializes in that area.  After exchanging records regarding the accident, we will take depositions (fronting all costs) and then attempt to settle your case with a mediator assisting. This is successful 90+% of the time, but if necessary to protect your interests, we will proceed to trial, in which I am Board Certified.    Although each case is unique,  a reasonable expectation is your case will be resolved in about two years from the initial FREE CASE EVALUATION.

If you or a loved one need a personal injury attorney who knows where it hurts, please call.
We represent injured construction workers and their friends and families in scaffold accidents, iron working accidents, trench collapses, road construction accidents, Work Injuries and crane accidents throughout Indiana, including Indianapolis, Fort Wayne, Evansville, Terre Haute, Bloomington, Richmond and South Bend. You just signed the biggest case of your legal career. Congratulations! Now What?

Your Indiana Construction Accident lawyer knows exactly how to handle cases involving wrongful death, traumatic brain injury, parapalegia, broken bones and electrical injuries because I do it on a daily basis.  Many of my cases are referrals and co-counsel opportunities with other personal injury attorneys who have a  more general practice. I generally assume the responsibility for proving the liability aspect of the case and work with the other personal injury attorney on proving damages, including medical bills, wage loss, future medicals and earning impairment. I also work with the worker's compensation insurance company on resolving thier statutory lien on a third party recovery.  If a  medicare set aside or other trust is needed, we can solve that problem as well. Finally, I generally recommend structured payments to maximize recovery and minimize taxes for our clients.
