Being a personal injury lawyer in Indiana is a privilege and not a right. Personal injury clients, however, do have rights, and that I would take this opportunity to enumerate at least some of them.
1. The right to have phone calls return promptly.
2. The right to be kept informed of the status of their case.
3. The right to be honestly told of the value of their case, not just in the end, but also in the beginning.
4. The right to be charged a reasonable fee.
5. The right to be referred to another lawyer when necessary.
6. The right to have their case proceed to as quick a favorable resolution as possible.
7. The right to have a lawyer who is willing to try the case.
8. The right to have a lawyer who is willing to advance the necessary cost of prosecuting the case.
9. The right to determine whether to accept a settlement offer or proceed to trial.
10. The right to speak directly to the attorney they hired, and not an associate or paralegal.
While these are just some of the rights every personal injury client should have, unfortunately, not all attorneys are willing to recognize them. I will keep a copy close at hand to remind me of my client's rights, and my obligations to them.
